CABIN AGREEMENT
This rental agreement is made effective between Falcon’s Nest, LLC (hereby referred to as Lessor) and the cabin guest (hereby referred to as Lessee). By signing this agreement, Lessee acknowledges that they have read and understand the Cabin Rules and that they agree to abide by said Cabin Rules. A copy of these Cabin Rules is located on our website and available from our staff upon request.
RIGHT TO REFUSE SERVICE:
Lessor reserves the right to refuse service to anyone for any reason(s) that does not violate Federal or State laws. Lessor has a zero-tolerance policy in which we will refuse to admit or refuse service or accommodation in our accommodations or may remove a person, without refund, who refuses to abide by the reasonable standards and policies established by the State of Utah and the owners for the operation and management of the hotel. Lessor will refuse service or evict a guest: for refusal or failure to pay for accommodations, if guest is under the influence of alcohol, drugs, or any other intoxicating substance and acts in a disorderly fashion as to disturb the peace of other guests, or is not in compliance with state liquor laws; acts in a disorderly fashion as to disturb the peace of other guests; is unable to properly supervise their children at all times, seeks to use the hotel for an unlawful purpose; seeks to bring into the hotel: an unlawfully possessed firearm; or something, including an explosive or hazardous or toxic substance, that is unlawful to possess and that may be dangerous to other persons; destroys, damages, defaces, or threatens harm to hotel property or guests; causes or permits persons to exceed the maximum allowable occupancy of room, refuses to abide by the reasonable standards or policies established by Lessor.
PARKING AT OWN RISK:
All vehicles are parked at the risk of the Lessee. Lessor shall not assume liability or responsibility for any vehicle, occupants, or contents while operated or parked on the property. If a vehicle is left in the parking lot after the guest has departed without the written consent of Falcons Nest, Lessor has the right to have the vehicle towed at the Lessee’s expense. Vehicle repairs are not permitted on hotel premises.
100% NON SMOKING
No smoking of any kind is allowed inside the cabins. Smoking inside cabins will result in a $250 cleaning fee charged to Lessee's debit/credit card. Should it be discovered after Lessee's departure that Lessee smoked inside the cabin, Lessor reserves the right and is hereby authorized to charge the cleaning fee to the card on file.
DAMAGE AND/OR THEFT OF PROPERTY"
Lessee is liable for any damage howsoever caused (whether by the deliberate, negligent, or reckless act) to the cabin(s), premises or property caused by Lessee or any person in Lessee’s party whether or not staying at the cabins during your stay. Lessor reserves the right to retain your credit card and/or debit card details as presented at registration and charge or debit the credit /debit card such amounts as it shall in its sole discretion deem necessary to compensate or make good the cost or expenses incurred or suffered by Lessor as a result of the aforesaid. Should this damage come to light after Lessee has departed, Lessor reserves the right and is hereby authorized by Lessee to charge Lessee’s credit or debit card for any damage incurred to the cabin or the property during Lessee’s stay, including and without limitation for all property damage, missing or damaged items, smoking fee, cleaning fee, guest compensation, etc. Lessor will make every effort to rectify any damage internally prior to contracting specialist to make the repairs, and therefore will make every effort to keep any costs that the Lessee would incur to a minimum.
DAMAGE TO CABIN:
Damage to rooms, fixtures, furnishing and equipment including the removal of electronic equipment, towels, art work, etc. will be charge at 120% of full and new replacement value plus any shipping and handling charges. Any damage to hotel property, whether accidental or willful, is the responsibility of the Lessee for each particular room. Any costs associated with repairs and/or replacement will be charged to the credit card of the Lessee. In extreme cases, criminal charges will be pursued.
Damage to mattresses and linen including; towels, mattress pads, sheets, bedspreads, blankets resulting from the use of body oils, make-up, shoe-polish, etc. will result in a charge for the special cleaning, repair or replacement of the damaged article.
DAMAGE OR TAMPERING WITH FIRE DETECTION SYSTEMS/FIRE-FIGHTING EQUIPMENT:
Lessor reserves the right to take action against any guest or visitor found to have tampered or interfered with any fire equipment throughout the cabins/property, including detectors, extinguishers, and fire escape ladders. If found to have tampered with any fire detection or fire-fighting equipment, Lessee will be charged with any costs incurred by Lessor due to Lessee’s actions and will be evicted from the cabins. Depending on the severity of the guest actions, law enforcement may become involved at the Lessor’s discretion. Should the fact that fire-fighting or detection equipment had been tampered with come to light after the Lessee has departed, Lessor reserve the right and is hereby authorized to charge Lessee’s credit or debit card for any damage incurred to the cabin or property during Lessee’s stay, including and without limitation for all property damage, missing or damaged items, smoking fee, cleaning fee, guest compensation, etc.
LIABILITY AND INDEMNITY:
Lessee hereby agrees to bind him/her self, their heirs, personal representatives, and assigns and releases and discharges the Lessor, its owners, employees, agents, and assigns from any and all claims of loss, costs, damages, expenses, actions, judgments, and attorney fees which the Lessee or Lessee’s heirs, personal representatives or assigns may have, or claim to have, against Lessor, its owners, employees, agents and assigns. Further, Lessee hereby agrees to defend, indemnify and hold harmless, Lessor, its owners, employees, agents and assigns from all claims, damages, costs, loss, expenses, actions and judgments, which are created by or arise out of Lessee’s use of the rental unit(s). Lessee agrees to pay all claims brought by third parties resulting from Lessee's use of the cabin(s).
Lessee expressly agrees to indemnify and hold Lessor harmless of, from and against any and all loss, costs, damages, attorney fees and or liability in connection with the enforcing of the foregoing rental contract by Lessor. Lessee agrees to pay in full any and all expenses incurred in the collection or attempting to collect delinquent balances, including suit by Lessor to recover possession of said rented unit(s) and/or to enforce any of the terms, conditions, and/or provisions hereof. It is understood and agreed that the venue of any action hereunder shall be in the county of the Lessor. Lessee also agrees that any and all situations that arise from their use of the cabin(s) shall be viewed, held, and ruled in the best possible favor of the Lessor.
CHANGES OR MODIFICATION TO THE HOTEL POLICY/CABIN RULES:
Lessor reserves the right to amend, modify, change, cancel, vary or add to these Cabin Rules or the arrangements and content featured on the website at any time without prior notice. Please check the Falcons Nest website regularly for updates to our Cabin Rules. Any modification to these Cabin Rules that occurs before your departure is considered a part of your reservation agreement with us.
Lessee is fully responsible for any and all damages that arise from failure to abide by the Cabin Rules and/or breaking with any of the Cabin Agreement contained herein.
Lessee acknowledges and agrees that failure by Lessor to enforce a specific clause in this contract does not void any other clause contained within.
Lessor reserves the right to cancel this rental agreement for any reason.
